1. Introduction
1.1 Welcome to the website of JHG Personnel Practitioners (“JHG“, “we“, “us” or “our“), available at www.jhg.co.za (the “Website“).
1.2 These Terms and Conditions (“Terms“) govern your access to and use of the Website. By accessing, browsing or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.
1.3 Some provisions of these Terms are printed in bold. These provisions may limit our liability, place risk on you, or require you to indemnify us, and you should read them carefully. This is in line with the Consumer Protection Act 68 of 2008 (“CPA“).
1.4 These Terms should be read together with our Privacy Policy, which forms part of these Terms.
2. Information about JHG
In accordance with section 43 of the Electronic Communications and Transactions Act 25 of 2002 (“ECTA“), we provide the following information:

3. Use of the Website
3.1 You may use the Website only for lawful purposes and in accordance with these Terms.
3.2 You must not:
- use the Website in any way that breaches any applicable South African or international law;
- attempt to gain unauthorised access to the Website, its servers, or any connected systems or databases;
- introduce viruses, malware or any other harmful material, or carry out any act that is an offence under the Cybercrimes Act 19 of 2020;
- copy, scrape, harvest or extract data from the Website by automated means without our written permission;
- submit false, misleading or defamatory information, or impersonate any person; or
- use the Website to send unsolicited commercial communications.
3.3 If you are under 18 years of age, you may only use the Website with the consent and supervision of a parent or legal guardian.
3.4 We may suspend or restrict your access to the Website if we reasonably believe you have breached these Terms.
4. Information on the Website is not professional advice
4.1 The Website contains general information about labour law, payroll, human resources and compliance matters. This information is provided for general guidance only and does not constitute legal, tax, financial or professional advice.
4.2 South African labour, tax and compliance legislation changes regularly, and every workplace situation is different. You should not act or refrain from acting on the basis of information on the Website without first obtaining advice specific to your circumstances.
4.3 Reading the Website, sending us an enquiry, or receiving a general response from us does not create a client relationship between you and JHG.
5. Our services
5.1 Descriptions of our services on the Website are for information purposes and do not constitute an offer capable of acceptance.
5.2 Our services are provided under a separate written service agreement, mandate or engagement letter (“Service Agreement“). If there is any conflict between these Terms and a Service Agreement, the Service Agreement will apply to the services concerned.
5.3 Any quote we provide is valid for [30 (thirty)] days from the date of issue, unless stated otherwise, and is subject to the terms of the Service Agreement. Unless stated otherwise, all prices are quoted in South African Rand and [include / exclude] VAT.
6. Enquiries and information you submit
6.1 When you submit information through the Website (for example, through a contact form), you confirm that the information is accurate, complete and not misleading, and that you are entitled to share it.
6.2 If you share personal information about another person, you confirm that you have their permission or another lawful basis to do so.
6.3 We will process all personal information you submit in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (“POPIA“).
6.4 Please do not send us confidential or sensitive information (such as ID numbers, bank details, or medical information) through general contact forms. We will provide a secure method for sharing this information once you engage our services.
7. Job seekers and candidates
7.1 If you submit your CV or apply for a position through the Website or through us, you confirm that the information you provide is true and accurate. Providing false information may lead to your application being withdrawn.
7.2 Submitting a CV does not guarantee an interview, placement or employment. Final hiring decisions are made by the relevant employer.
7.3 In line with the Employment Services Act 4 of 2014, JHG does not charge job seekers any fee for placement services. If anyone claiming to represent JHG asks you for payment in exchange for a job, please report it to us immediately at hello@jhg.co.za.
7.4 Background, credit, qualification or criminal record checks will only be conducted with your consent, where required by law.
8. Intellectual property
8.1 All content on the Website, including text, graphics, logos, icons, images, designs, and software, as well as the JHG name and brand, is owned by or licensed to JHG and is protected by South African and international intellectual property laws.
8.2 You may view, download and print content from the Website for your personal, non-commercial use, provided that you do not modify it and that you keep all copyright and ownership notices intact.
8.3 You may not reproduce, distribute, publish, adapt or commercially use any Website content, or use the JHG name or logo, without our prior written consent.
9. Links to third-party websites
The Website may contain links to third-party websites and social media platforms for your convenience. We do not control these websites and are not responsible for their content, availability, privacy practices or security. A link does not mean that we endorse the website or its owner. Your use of third-party websites is at your own risk and subject to their terms.
10. Electronic communications
10.1 You agree that we may communicate with you electronically, including by email and through the Website, and that these communications satisfy any legal requirement that a communication be in writing, as provided for in ECTA.
10.2 A data message sent by you to us is regarded as received only when we have acknowledged receipt of it or responded to it. A data message sent by us to you is regarded as received when it enters your information system.
11. Website availability and security
11.1 We try to keep the Website available, accurate and up to date, but we do not guarantee that it will be uninterrupted, error-free, or free of viruses or other harmful components.
11.2 We may change, suspend or discontinue any part of the Website at any time without notice.
11.3 You are responsible for using appropriate security measures, such as antivirus software, when accessing the Website.
12. Disclaimer and limitation of liability
12.1 The Website and its content are provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties or representations, express or implied, about the accuracy, completeness, reliability or suitability of the Website or its content.
12.2 To the fullest extent permitted by law, JHG, its directors, employees and agents will not be liable for any direct, indirect, special or consequential loss or damage (including loss of profit, data or business opportunity) arising from or in connection with your use of, or inability to use, the Website, any reliance on its content, or any linked third-party website.
12.3 Nothing in these Terms limits or excludes any liability or right that cannot lawfully be limited or excluded, including any rights you may have as a consumer under the CPA or ECTA, or liability arising from our gross negligence or wilful misconduct.
12.4 Our liability in relation to services provided under a Service Agreement is governed by that Service Agreement.
13. Indemnity
You indemnify JHG, its directors, employees and agents against any claims, losses, damages, costs and expenses (including reasonable legal fees) arising from your breach of these Terms or your unlawful or improper use of the Website.
14. Cooling-off rights
If you are a consumer and you conclude an electronic transaction with us through the Website, you may have the right to cancel it within the cooling-off period provided for in section 44 of ECTA, subject to the exclusions in section 42 of ECTA. This right does not apply to services that have already begun with your consent before the end of the cooling-off period, or to agreements concluded other than through the Website.
15. Privacy
We respect your privacy and handle personal information in accordance with POPIA. Please read our Privacy Policy to understand how we collect, use and protect your personal information and what your rights are.
16. Governing law and jurisdiction
16.1 These Terms are governed by and interpreted in accordance with the laws of the Republic of South Africa.
16.2 Before instituting legal proceedings, the parties will first try in good faith to resolve any dispute through negotiation by contacting each other in writing.
16.3 Subject to clause 16.2, you consent to the jurisdiction of the courts of the Republic of South Africa, and, where applicable, the Magistrates’ Court having jurisdiction, in terms of section 45 of the Magistrates’ Courts Act 32 of 1944, even if the amount in dispute exceeds its usual monetary limit.

18. General
18.1 Changes to these Terms: We may amend these Terms at any time by publishing an updated version on the Website. The updated Terms apply from the date of publication. Your continued use of the Website after that date means you accept the updated Terms.
18.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force.
18.3 No waiver: Any leniency or delay by us in enforcing these Terms does not waive or limit our rights.
18.4 Entire agreement: These Terms, together with our Privacy Policy, form the entire agreement between you and JHG regarding your use of the Website, but do not replace any Service Agreement.
18.5 Assignment: We may cede or transfer our rights and obligations under these Terms. You may not do so without our written consent.
